Please read these Terms of Service (Terms) carefully before using the website at smartdaily.io or any of the SmartDaily Chrome extensions: FocusFlow, DemoRec, SalatGuard, and SnapEdit (collectively, the Services).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you (User) and SmartDaily (we, us). You must be at least 13 years old and capable of entering into a binding contract to use our Services. By completing a purchase or installing an extension, you confirm you meet these requirements.
2. Description of Services
SmartDaily offers four Chrome browser extensions available in free and Pro tiers:
Free tiers are available with limited features. Pro tiers are unlocked via a one-time license key purchase.
3. License grant
Upon purchasing a Pro license, SmartDaily grants you a personal, non-exclusive, non-transferable, revocable license to install and use the applicable extension on devices you personally own or control, for personal or professional use.
You may not:
- Share, sell, rent, sublicense, or distribute your license key to others.
- Reverse engineer, decompile, or attempt to extract the source code of the extensions.
- Use the extensions to develop a competing product.
- Remove or alter any copyright, trademark, or proprietary notices.
- Use automated tools to scrape, copy, or replicate functionality of the Services.
4. Purchases and payment
All purchases are processed securely by Stripe. By completing a purchase, you agree to Stripe's Terms of Service.
- All prices are in USD and include applicable taxes where required.
- Purchases are one-time payments. There are no recurring subscriptions.
- Your license key is delivered to the email address you provide at checkout.
- SmartDaily reserves the right to change pricing at any time. Price changes do not affect existing purchases.
5. Refund policy
Due to the digital and immediately deliverable nature of our products, all sales are generally final. However, we offer refunds under the following circumstances:
- The extension does not function as described and we are unable to resolve the issue within 7 days.
- You were charged in error (duplicate purchase, billing error).
- You request a refund within 7 days of purchase and have not extensively used Pro features.
To request a refund, email yoursmartdaily@gmail.com with your order details. Approved refunds are processed within 5–10 business days.
6. Free tier and limitations
Free tier users may use the limited features of each extension at no cost, indefinitely. SmartDaily reserves the right to adjust, restrict, or discontinue free tier features at any time with reasonable notice.
7. Updates and continuity
Pro license holders receive all future updates to the extension they purchased at no additional charge, for as long as the extension is actively maintained. SmartDaily does not guarantee that updates will be delivered on any particular schedule.
SmartDaily reserves the right to discontinue any extension with at least 30 days' notice. In the event of discontinuation, Pro license holders will be eligible for a pro-rated refund at our discretion.
8. Intellectual property
All content on smartdaily.io and within the extensions — including but not limited to source code, design, logos, icons, graphics, and text — is the exclusive property of SmartDaily and is protected by applicable intellectual property laws.
Nothing in these Terms grants you any ownership or intellectual property rights. All rights not expressly granted are reserved.
9. Prohibited conduct
You agree not to use the Services to:
- Violate any applicable law or regulation.
- Infringe the intellectual property or privacy rights of others.
- Attempt to gain unauthorised access to our systems or databases.
- Circumvent, disable, or tamper with security features or license verification.
- Use the Services in any way that could harm SmartDaily's reputation or other users.
Violation of these terms may result in immediate termination of your license without refund.
10. Disclaimer of warranties
The services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
SmartDaily does not warrant that the services will be uninterrupted, error-free, or free of viruses or other harmful components. You use the services at your own risk.
11. Limitation of liability
To the maximum extent permitted by law, SmartDaily shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, profits, goodwill, or other intangible losses — arising out of or in connection with your use of the services.
In no event shall SmartDaily's total liability to you exceed the amount you paid to SmartDaily in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless SmartDaily and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party rights.
13. Termination
SmartDaily may suspend or terminate your access to the Services at any time, with or without cause, if you violate these Terms. Upon termination, your license key will be deactivated and you must cease all use of Pro features.
You may stop using the Services at any time. Sections 8, 10, 11, 12, and 14 survive termination.
14. Governing law and disputes
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Services shall first be attempted to be resolved informally by contacting us at yoursmartdaily@gmail.com.
If informal resolution fails, disputes shall be resolved through binding arbitration or in courts of competent jurisdiction. You waive any right to participate in class-action lawsuits against SmartDaily.
15. Changes to these terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. If we make material changes, we will notify users via a notice on our website. Continued use of the Services after changes constitutes your acceptance of the revised Terms.
